California Job Applicant and Personnel Privacy Notice

Introduction

This California Job Applicant Privacy Notice explains how SunSource collects, uses, retains, and discloses personal information relating to California residents who apply for employment or other work opportunities with us.

This Notice applies to personal information collected in the recruiting, application, interview, evaluation, and hiring process, including through our careers page, recruiting systems, email communications, and other interactions relating to a job opportunity.

This Notice does not apply to personal information collected from individuals acting solely as customers, website visitors outside the application process, or representatives of vendors and business partners in non-employment contexts. Those data practices are described in our general Privacy Policy.

Categories of Personal Information We Collect

Depending on the role, the stage of the application process, and applicable law, we may collect the following categories of personal information:

  • Identifiers such as your name, postal address, email address, telephone number, username and password for an applicant portal, online identifiers, IP address, and government-issued identifiers where needed for hiring or onboarding.
  • Personal information described in California Civil Code section 1798.80(e) such as signature, address, telephone number, education information, employment history, financial information, or other information you provide in connection with an application or potential employment relationship.
  • Professional or employment-related information such as resume or CV information, cover letter content, qualifications, skills, certifications, licenses, references, work history, compensation expectations, interview notes, recruiting communications, and information relating to candidacy for a position.
  • Education information such as schools attended, degrees, transcripts, training, academic history, or other education-related information you provide.
  • Internet or other electronic network activity information such as device information, browser type, interactions with our careers page or recruiting systems, and related usage information collected when you submit an application or use recruiting tools.
  • Geolocation data such as approximate location information derived from your IP address or device when you interact with our careers page or recruiting systems.
  • Sensitive personal information where permitted by law and as applicable to the role or process, we may collect sensitive personal information, such as government identification numbers, account log-in credentials, precise geolocation, racial or ethnic origin, citizenship or immigration status, union membership, health information, or other sensitive personal information contained in materials you provide or collected during the recruiting, hiring, or onboarding process. 

Sources of Personal Information

We may collect personal information about you from the following categories of sources:

  • directly from you, such as when you complete an application, upload a resume, communicate with us, or participate in an interview; 
  • from recruiters, staffing agencies, or referral sources; 
  • from your references, prior employers, educational institutions, licensing bodies, or credentialing sources, where permitted by law; 
  • from publicly available sources, such as professional networking profiles or public licensing records; 
  • automatically from your device or browser when you use our careers page or applicant portal; and 
  • from service providers that assist with recruiting, applicant tracking, communications, interviewing, background screening, or onboarding. 

Purposes for Which We Use Personal Information

We may collect, use, and otherwise process applicant personal information for the following business and commercial purposes:

  • to receive, review, and process your application; 
  • to assess your qualifications, eligibility, and suitability for a position; 
  • to communicate with you about your application, candidacy, interviews, and hiring decisions; 
  • to schedule and conduct interviews and evaluations; 
  • to verify information provided in connection with your application; 
  • to conduct reference checks, credential verification, and background screening, where permitted by law; 
  • to support onboarding and employment-related administration if you are hired; 
  • to improve and administer our recruiting and hiring processes; 
  • to maintain records relating to recruiting, hiring, and compliance; 
  • to protect the security and integrity of our systems, facilities, and information; and 
  • to comply with applicable legal, regulatory, reporting, and internal governance obligations. 

How We Disclose Personal Information

We may disclose the categories of personal information described above to the following categories of recipients for business purposes:

  • recruiting, applicant-tracking, and interview-management providers; 
  • background check, credentialing, and reference-check providers, where permitted by law; 
  • technology, hosting, communications, and security providers; 
  • human resources, payroll, benefits, and onboarding providers, where applicable; 
  • professional advisors, such as lawyers, auditors, and consultants; 
  • government entities, regulators, law enforcement, or other parties where required by law; and 
  • parties involved in a corporate transaction, such as a merger, acquisition, reorganization, or sale of assets. 

We do not sell or share personal information collected about California job applicants for cross-context behavioral advertising.

Sensitive Personal Information

We do not use or disclose sensitive personal information relating to job applicants except as reasonably necessary and proportionate for recruiting, hiring, onboarding, security, legal compliance, and other permitted business purposes, or as otherwise authorized by law.

Retention

We retain applicant personal information for as long as reasonably necessary to fulfill the purposes described in this Notice, including to evaluate your candidacy, comply with legal obligations, resolve disputes, enforce agreements, maintain required records, and protect our rights and interests.

If you become an employee or contractor, relevant applicant information may be retained and incorporated into your personnel file or other employment records.

When determining retention periods, we consider the nature and sensitivity of the information, the purposes for which it was collected, applicable legal requirements, recordkeeping needs, and whether the information is necessary to establish, exercise, or defend legal claims.

Security

We implement reasonable administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, destruction, use, modification, or disclosure.

No data transmission or storage system can be guaranteed to be completely secure. You should use care in deciding what information you submit through the careers page and related systems.

Your California Privacy Rights

Subject to applicable law and verification, California applicants may have the right to request:

  • access to the categories and specific pieces of personal information we have collected about them; 
  • information about the categories of sources, purposes of collection, and categories of recipients; 
  • deletion of personal information, subject to exceptions; 
  • correction of inaccurate personal information; and 
  • information about whether personal information was sold, shared, or disclosed for a business purpose. 

You may also designate an authorized agent to make certain requests on your behalf, subject to applicable verification requirements. 11 CCR § 7063.

We will respond in accordance with applicable law. The CCPA generally requires businesses to provide designated request methods and to respond within 45 days, subject to one 45-day extension where reasonably necessary.
